À l’avenir, ces entités — également appelées personnes morales — seront contrôlées par des organismes tels que le Secrétariat à l’économie et non plus seulement supervisées par leurs institutions respectives.
Le motu proprio est complété par une loi couvrant les entités de l’État de la Cité du Vatican. Les deux ont été publiés le 6 décembre et entrent en vigueur le 8 décembre.
Le pape François a noté dans sa lettre apostolique que les fondations et autres entités concernées “contribuent à la réalisation des fins propres aux institutions curiales au service du ministère du Successeur de Pierre”.
Il fallait donc, ajoutait-il, « qu’elles soient soumises non seulement à la tutelle des institutions curiales dont elles dépendent, mais aussi au contrôle et à la surveillance des organes économiques de la Curie romaine ».
Les personnes morales instrumentales déjà existantes devront se conformer aux dispositions du motu proprio dans un délai de trois mois.
Le champ d’application de la loi est limité, selon Vatican News : il ne s’étend pas aux « institutions curiales et aux bureaux de la Curie romaine, aux institutions liées au Saint-Siège, au gouvernorat de l’État de la Cité du Vatican et aux entités professionnellement engagées dans les activités d’un nature financière. »
La nouvelle fait suite à l’annonce, le 30 novembre, de la nomination par le pape François de Maximino Caballero Ledo, 62 ans, à la tête du Secrétariat à l’économie suite à la démission du père jésuite Juan Antonio Guerrero. Le laïc espagnol est secrétaire général, le poste de deuxième rang, au bureau de l’économie depuis août 2020.
Le pape François a créé le Secrétariat à l’économie en 2014 dans le cadre de sa réforme financière du Vatican. Il supervise les aspects financiers de la Curie romaine et de l’administration de l’État de la Cité du Vatican, y compris l’examen des rapports financiers.

Era, por isso, necessário, acrescentou, “que estivessem sujeitos não só à tutela das instituições curiais de que dependem, mas também ao controlo e vigilância dos órgãos económicos da Cúria Romana”.
As pessoas colectivas instrumentais já existentes terão de cumprir as disposições do motu proprio no prazo de três meses.
O alcance da lei é limitado, de acordo com o Vatican News: não se estende a “instituições curiais e escritórios da Cúria Romana, instituições ligadas à Santa Sé, ao Governo do Estado da Cidade do Vaticano e entidades profissionalmente engajadas em atividades de natureza financeira”.

The scope of the law is limited, according to Vatican News: It does not extend to “curial institutions and offices of the Roman Curia, institutions connected with the Holy See, the Governorate of Vatican City State, and entities professionally engaged in activities of a financial nature.”
The news follows the announcement on Nov. 30 that Pope Francis has appointed Maximino Caballero Ledo, 62, to lead the Secretariat for the Economy following the resignation of Jesuit Father Juan Antonio Guerrero. The Spanish layman has been secretary general, the second-ranking position, in the economy office since August 2020.
Pope Francis established the Secretariat for Economy in 2014 as part of his financial reform of the Vatican. It oversees the financial aspects of both the Roman Curia and the Vatican City State administration, including a review of financial reports.
